Mandatory health insuance both a tax & not a tax

The Hill reports that federal law prevents the Supreme Court from blocking taxes before they take effect. The so-called Justice Department supports ObamCare’s mandatory insurance provision wants the Supreme Court to decide soon whether the mandate is Constitutional, & prefers that –when deciding whether it can take the case — the Court should not consider the mandate to be a tax. But once the Court decides to rule on Constitutionality of the mandate, the DOJ will argue that it is a tax.
